A Global AI Governance Decalogue for Procurement

The Regulatory Patchwork

The following national and supranational instruments form the foundation of today’s most stringent AI obligations (note that while this selection highlights the most influential and widely referenced regulatory frameworks, it does not encompass the full scope of AI legislation globally):

    • EU AI Act (2024): Establishes a risk-based framework that bans certain AI uses and imposes strict obligations on high-risk systems, including transparency, human oversight, and conformity assessments.
    • U.S. Executive Order (EO) 14110 (2023): Sets out a whole-of-government strategy to promote safe, secure, and trustworthy AI through agency mandates on safety testing, civil rights protections, innovation, and international cooperation.
    • Brazil PL 2338 (2024 draft): Similar to the EU AI Act, it proposes a rights-based, risk-tiered regulatory model that prohibits harmful AI practices, mandates algorithmic impact assessments for high-risk systems, and establishes civil liability and oversight mechanisms.
    • China’s Interim Measures on Generative AI (2023): Introduces content-focused rules for generative AI providers, emphasizing alignment with socialist values, data security, and user identity verification.
    • Canada C-27 (AIDA, 2022): Regulates high-impact AI systems in interprovincial and international commerce by requiring risk assessments, mitigation measures, transparency, and ministerial oversight, with a focus on preventing biased outputs.
    • Singapore AI Verify (2022): Provides a voluntary, checklist-based testing methodology for assessing AI systems against 11 governance principles such as transparency, fairness, robustness, and accountability.

Despite sharing a commitment to AI governance, the frameworks of each jurisdiction reflects markedly different regulatory temperaments shaped by national values and policy priorities: the EU adopts a privacy‑forward, protective posture; the U.S. favors flexibility and innovation; Brazil strives for responsible and human‑centered regulation but remains more exploratory and less prescriptive; China enforces a politically guided model balancing rapid rollout with ideological oversight; Canada treads a balanced, risk‑based path that seeks to merge protection and innovation within a democratic governance ethos; and Singapore opts for a more pragmatic, voluntary checklist rather than coercive mandates.

Even with these jurisdictional differences, four regulatory themes recur: safety, fairness, transparency, and accountability.

Why One Decalogue Helps Sourcing Teams
